General terms and conditions of Neumühle Hotel- und Gaststättenbetriebs GmbH

01. If a hotel room / function room is ordered, confirmed or made available, a guest accommodation contract / rental agreement has been concluded. The contract for a hotel room includes bed and breakfast. The contract for functional rooms only includes the use of the functional room. The agreed fee is the current daily price.

02. The subletting or subletting of functional rooms, exhibition or advertising space requires the prior written consent of Neumühle Hotel- und Gaststättenbetriebs GmbH (hereinafter referred to as hotel).

03. Room reservations are held until 6 p.m. on the day of arrival, after which they go on sale. Guaranteed bookings are an exception.

04. Option bookings are binding for both contractual partners. The hotel reserves the right to allocate the reserved hotel rooms/function rooms to someone else after the option bookings have expired.

05. The agreed prices include the respective statutory VAT. If the period between the conclusion of the contract and the agreed arrival date exceeds four months and the price generally charged by the hotel for the contractual services increases, the contractually agreed price can be increased appropriately, but by a maximum of 10 %.

06. If the customer subsequently wishes to make changes to the number of rooms ordered, other hotel services or the length of stay of the guests, this requires the hotel's written consent, which can be made dependent on a price adjustment.

07. If and to the extent that a free right of withdrawal has been agreed in writing in favor of the customer, for example in the case of optioned bookings, the hotel is entitled to withdraw from the contract within the agreed period for exercising the right of withdrawal if the hotel has received inquiries from third parties about the rooms ordered by the customer and the customer does not waive the right of withdrawal granted to him upon inquiry by the hotel and notification of such facts.

08. If advance payments requested by the hotel are not made on the requested date, this immediately releases the hotel from the contractual agreements made.

09. The reserved hotel room is available to the guest from 3 p.m. on the day of arrival until 11 a.m. on the day of departure. A later departure than 11 a.m. requires agreement with reception the evening before. If you depart after 11 a.m., the current daily room rate can be charged.

10. Booked functional rooms are only available to the contractual partner at the agreed times. Any use beyond this requires prior agreement with the hotel.

11. The contractual partner is not entitled to specific hotel rooms/function rooms. If the agreed hotel rooms/function rooms are exceptionally unavailable, regardless of the reason, the hotel will endeavor to procure an equivalent replacement.

12. Price information: The prices stated on our website, in advertising materials and in other publications are always carefully calculated and set in good faith. These prices serve as a binding basis for the accommodation contract.

Incorrect Pricing: Despite our efforts to be accurate, it may occur that erroneous pricing is posted on our website or in our promotional materials. Such errors may occur due to technical problems, typographical errors or other unforeseeable circumstances.

Correction and withdrawal: In the event of an obvious price error, Neumühle Resort & SPA reserves the right to cancel the affected bookings and withdraw from the accommodation contract. An obvious pricing error occurs when the published price deviates significantly from the actual market price for the relevant service and is recognizable to an average customer.

Price Error Communication: If a booking is made due to an apparent price error, we will contact affected guests immediately to explain the error and offer an appropriate solution, such as rebooking at the correct price or cancellation without cancellation fees.

Goodwill offers: In cases where a cancellation occurs due to a price error, the Neumühle Resort & SPA will endeavor to accommodate the affected guests, for example through special discounts or other offers for future stays.

We ask our guests to observe these regulations in connection with price errors and thank you for your understanding and cooperation.

13. The hotel makes its staff available to the organizer until 1 a.m. For a service that goes beyond this and for catering services, the organizer will be billed at the applicable hourly rate per employee per hour.

14. In the event of short-term redesigns of room furnishings that have already been ordered and require considerable effort, we charge the applicable hourly rate per employee per hour.

15. When changing or canceling booked function rooms / hotel rooms / package arrangements, the following will be charged:

  1. up to 15 days before arrival no costs 14 – 8 days before arrival 75 % of the agreed service 7-0 days before arrival 80 % of the agreed service
  2. From 30 overnight stays per event, the deadlines mentioned under point 14 a) are extended by 30 days
  3. Due to reduced, previously contractually agreed contractual services, the hotel can withdraw special prices, demand new agreements or withdraw from the contract without replacement because sales guarantees cannot be achieved.
  4. The deadline that must be met to completely cancel a booking of up to 6 rooms free of charge depends on the total length of stay originally booked. Cancellation is free of charge if the following deadlines are met:
    – by 12:00 p.m. the day before arrival for stays of up to 3 nights – by 12:00 p.m. seven days before arrival for stays of 4 nights or more
    – After these deadlines have expired, 80% of the booked services become due.
    – Excepted from this are bookings for rates that cannot be canceled or rebooked due to their discount.
  5. In the event that reservations are rebooked, we reserve the right to charge a fee amounting to 20% of the originally booked service. If the newly booked services have a higher price, the difference must also be paid.
    – Excepted from this are bookings for rates that cannot be canceled or rebooked due to their discount.

16. The guest reserves the right to prove that the hotel suffered no damage or less damage than the agreed flat rate as a result of not using the service.

17. If the customer is not also the organizer, both are jointly and severally liable.

18. If the hotel has reasonable grounds to believe that the event threatens to endanger the smooth running of the business, the security or the reputation of the hotel or its guests, and in the event of force majeure, it may cancel the event; Asserting any claims for damages against the hotel is excluded.

19. Newspaper advertisements that contain the hotel's data for invitations to sales events or interviews, or the use of the name Neumühle Resort & SPA for advertising measures by the contractual partner generally require the hotel's prior written consent. If publication occurs without the hotel's consent and the hotel's essential interests are impaired as a result, the hotel is responsible for this

20. For shared meals (menus and buffets), the organizer must inform the hotel of the exact number of participants two working days before the start of the event. This number is considered the guaranteed minimum number and will be invoiced to the organizer by the hotel in any case. If events at which food is served are canceled by the organizer up to three working days before the start of the event, 75 % of the ordered menu/buffet price must be paid from the total agreed number of guests.

21. Bringing food and drinks with you is generally not permitted. Exceptions are only possible in consultation with the hotel and against payment of the usual service costs/corkage fee.

22. Attaching presentation material or other items is not permitted without the hotel's consent. All decorative material must meet fire safety requirements and must not leave any damage.

23. The purchaser of function rooms for events is obliged to remove all packaging and/or information material they have brought in at their own expense. If the customer does not comply with this obligation, he is obliged to reimburse the hotel for the disposal costs according to the applicable tariff.

24. The contractual partner is fully liable to the hotel for damage caused to the building and inventory by itself, its vicarious agents or its guests, unless the contractual partner can prove that the damage was less.

25. If the hotel arranges external services of a technical, decorative or other kind from third parties for the organizer, it acts in the name and on behalf of the organizer. The contractual partner is liable for the careful treatment and proper return of these items and releases the hotel from all third-party claims.

26. Guests paying individually must pay immediately in cash net. All guest accounts are payable weekly. Invoices sent based on previous credit agreements are payable without deductions within 10 working days of receipt of the invoice. In the event of late payment, the hotel will charge reminder costs and debt collection costs. In addition, default interest of 5 % above the base interest rate of the European Central Bank will be charged.

27. The hotel accepts the following credit cards: Mastercard, Diners, Amexco, Visa. Commission claims and special prices are excluded. The hotel is entitled to reject foreign currency, checks and credit cards in individual cases.

28. All prices are in euros, including service charges and VAT. Any increase in VAT or the introduction of a beverage tax will be borne by the service recipient, regardless of when the contract is concluded.

29. Services from package arrangements that are not used will not be refunded.

30. Malfunctions in the technical or other facilities provided will be eliminated immediately, as far as possible. However, payments cannot be withheld or reduced. Offsetting against counterclaims is excluded unless the counterclaims are undisputed and legally established.

31. Valuables, money or valuable papers (checks, credit cards, etc.) must be stored in the room safe. If these are not stored there, the hotel assumes no liability whatsoever.

32. The hotel endeavors to carry out wake-up calls with the greatest care; However, claims for damages due to omission are excluded. Items left behind will only be forwarded upon request and freight forwarded. The hotel undertakes to store it for 6 months. Messages intended for guests as well as mail and goods are handled with care. The hotel takes care of the storage; Delivery and, if requested, freight forwarding of the same. However, liability for loss, delay or damage is excluded.

33. Subsidiary agreements must be in writing. The invalidity of individual provisions of the contract or the conditions does not affect the validity of the other provisions. Instead of the invalid provisions, a valid provision that comes as close as possible applies.

34. Place of performance and exclusive place of jurisdiction is Wartmannsroth if the customer is a registered merchant, a legal entity under public law or a special fund under public law or if the customer does not have a general place of jurisdiction in the Federal Republic of Germany

35. Security measures and video surveillance

 

To ensure the safety of our guests and employees as well as to protect the property and works of art on the premises, the Neumühle Resort & SPA uses video surveillance technology throughout the outdoor area. The installation and use of these surveillance cameras is carried out in strict accordance with applicable data protection laws and in compliance with the right to privacy.

 

Video surveillance serves the sole purpose of preventing and solving crimes, ensuring the safety of those on the premises and protecting property. The recordings will be treated confidentially, viewed only by authorized personnel and will not be passed on to third parties unless there is a legal obligation or a court order.

 

The recordings are stored for a limited period of time, after which the data will be securely and irretrievably deleted, unless they need to be retained to clarify incidents or for legal reasons.
